Counsel, US Market Access and Operations (Pharma)

Location: Hybrid role based in either the Princeton, New Jersey or Cambridge office, with a 70/30 in-office work model. Only U.S. persons are eligible.

Salary: $183,800–$330,300 per year, with potential bonus, incentive compensation, or equity eligibility.

What you will do

• Provide legal advice to Market Access, Commercial Operations, Marketing, and Sales on commercialization matters.
• Advise on fraud-and-abuse and antitrust laws, including the Anti-Kickback Statute, False Claims Act, Robinson-Patman Act, and Sherman Act.
• Draft, review, and support negotiations for market access contracts with wholesalers, distributors, retailers, health systems, GPOs, payors, and large employers.
• Advise on pricing strategy, communications, government price reporting, and the impact of pricing or contracting proposals.
• Support federal government vaccine procurement solicitations and advise on state distribution licensure, government contract compliance, and the Drug Supply Chain Security Act.
• Advise on the development and launch of a digital direct purchasing platform and collaborate with Compliance on risk mitigation, SOPs, and policies.

Requirements

• Juris Doctor degree and admission to the bar in good standing in at least one jurisdiction.
• 8+ years of experience in-house or at a law firm supporting the pharmaceutical or biotech industry.
• Experience advising on legal issues involving marketed pharmaceutical products, including fraud and abuse and antitrust.
• Experience drafting, reviewing, and negotiating complex contracts, including U.S. channel and payor agreements.
• Strong understanding of pharmaceutical pricing and reimbursement in the U.S. marketplace.
• Must qualify as a U.S. person: citizen, permanent resident, asylee, or refugee. Non-U.S. persons are not eligible, and visa sponsorship is unavailable.

• Experience with federal government contracting and pharmaceutical government price reporting.
• Experience working with vaccines, wholesalers, distributors, integrated delivery networks, or retailers.
