TL;DR
Counsel (Regulatory) (Healthcare): Advising oncology practices and corporate stakeholders on healthcare regulations, structuring physician and vendor arrangements, and drafting and negotiating healthcare and commercial contracts with an accent on fraud and abuse laws, HIPAA, licensure, and corporate practice of medicine requirements. Focus on translating complex federal and state healthcare rules into practical guidance, policies, contract templates, and training while managing regulatory risk across a multi-site provider network.

What you will do

  • Advise corporate teams and affiliated clinical practices on federal and state healthcare regulatory matters.
  • Structure and document physician, vendor, and referral-source arrangements under applicable safe harbors and exceptions.
  • Draft, review, negotiate, and close physician employment, professional services, medical director, vendor, licensing, research, and business associate agreements.
  • Provide guidance on HIPAA, health information privacy and security, licensure, scope of practice, supervision, delegation, fee-splitting, and certificate of need requirements.
  • Monitor legal developments and translate them into practical policies, playbooks, contract templates, and training.
  • Partner with Compliance, operations, revenue cycle, integrations, human resources, outside counsel, and business stakeholders on reviews, remediation, inquiries, and complex projects.

Requirements

  • 5–7 years of relevant legal experience in a law firm or corporate legal department, including substantial healthcare regulatory work.
  • Working knowledge of the Anti-Kickback Statute, Stark Law, False Claims Act, and analogous state fraud and abuse laws.
  • Experience advising on HIPAA, health information privacy and security, professional and facility licensure, corporate practice of medicine, and fee-splitting restrictions.
  • Significant experience drafting and negotiating healthcare and general commercial contracts, preferably in physician practice management or multi-site provider environments.
  • Juris Doctorate from an accredited law school and membership in a state or District of Columbia bar.
  • Strong analytical, communication, organizational, judgment, collaboration, and independent project-management skills.

Nice to have

  • Experience with Medicare and Medicaid enrollment, conditions of participation, and payor regulatory requirements.
  • Experience with in-office dispensing, pharmacy regulation, data de-identification, data rights, and software licensing agreements.
