TL;DR

Product Counsel, ERISA & Operations (Fintech): Providing legal guidance on ERISA, IRC, and fiduciary obligations for a 401(k) recordkeeping platform with an accent on integrating regulatory frameworks into product features and operational workflows. Focus on advising customer-facing teams on complex compliance matters and partnering with product teams to build ERISA-compliant automation.

Salary: $170,000–$210,000 annually

What you will do

  • Act as the primary legal advisor to customer-facing teams on ERISA, IRC, and fiduciary questions across the full customer lifecycle.
  • Translate complex regulatory requirements into clear, actionable guidance for product managers and engineers to build against.
  • Review participant-facing communications, SPDs, and disclosures to ensure ERISA compliance.
  • Analyze how proposed product features trigger 3(16), 3(21), or 3(38) fiduciary duties and advise on the best path forward.
  • Draft and maintain internal legal policies, procedures, and educational resources to ensure consistent application of ERISA requirements.

Requirements

  • Must be based in the United States.
  • Admitted to the bar and in good standing, or authorized to practice law in any US state.
  • 5–8 years of substantive ERISA experience focused on qualified retirement plans and fiduciary matters.
  • Minimum of two years of experience practicing ERISA law at a law firm.
  • Deep knowledge of EPCRS, IRC qualification rules, and prohibited transaction rules.
  • Proficiency in using modern AI tools for legal research, drafting, and analysis.

Nice to have

  • In-house experience at a recordkeeper, TPA, fintech, or trust company.
  • Direct experience with 3(16), 3(21), or 3(38) fiduciary operations.
  • Experience providing legal input on product, operational, or technology decisions.
