Senior Counsel - Biotech Patent Law (Biotech)

Location: United States — Remote; the role may also be based near research or corporate sites in South San Francisco, Thousand Oaks, or Cambridge.

Annual salary: $250,321.60–$338,670.40 USD, excluding Puerto Rico.

What you will do

• Develop and execute global intellectual property strategies for therapeutic products and product candidates, including antibodies, immunotherapeutics, RNA therapies, and cell-based therapies.
• Work with scientists to identify patentable inventions and draft, file, and prosecute patent applications worldwide.
• Conduct prior art searches, patent analyses, and freedom-to-operate assessments.
• Perform IP due diligence for licensing, research collaboration, and acquisition transactions.
• Draft and negotiate IP provisions in transactional agreements and advise R&D and business partners.
• Support patent litigation, PTAB proceedings, opposition proceedings, and other adversarial matters.

Requirements

• J.D. or LL.M. degree from an accredited law school and admission to practice law in a U.S. jurisdiction.
• Registration to practice before the U.S. Patent and Trademark Office.
• At least six years of patent or intellectual property law experience in the biopharma or life sciences sector.
• Experience with biotechnology-related U.S. and foreign intellectual property law, patent preparation and prosecution, and IP due diligence.
• Strong legal analysis, drafting, communication, management, and leadership skills, with the ability to work independently and cross-functionally.
• Experience with adversarial proceedings such as patent litigation, inter partes reviews, post-grant reviews, or oppositions.

Nice to have

• Ten or more years of relevant experience, including pre-J.D. experience as a patent agent.
• Experience with patent matters involving nucleic acid therapeutics.
• Advanced degree in molecular biology, cell biology, microbiology, biochemistry, genetics, immunology, or a related field.
• Experience drafting and negotiating IP provisions in agreements.
